Job Purpose:

The Consumer Lending Compliance Officer (CLCO) is the regulatory compliance subject matter expert and responsible for being the first line of defense for Consumer Lending regulatory compliance. Will work with the SVP Consumer Lending and Consumer Lending department managers to ensure processes and controls are developed to ensure compliance with applicable regulations, including UDAAP, Fair Lending and the Community Reinvestment Act. Responsible for researching and retaining an understanding of new or changing regulations and ensuring impacted consumer lending business lines are aware. Participate in the development, evaluation and testing of a comprehensive compliance risk management program for Consumer Lending.

Job Duties:

  • Conduct Consumer Lending Compliance Risk Assessment a minimum of annually to identify areas of compliance vulnerability for applicable regulations, products and services.
  • Create annual Compliance Monitoring/Testing Plan based on the results of the Annual Risk Assessment.
  • Responsible for the completion of the Compliance Monitoring/Testing Plan and for preparing Consumer Lending Compliance Executive Summary for the Management Compliance Committee.
  • Oversee the remediation of identified findings including conducting research, maintaining documentation and calculating restitution.
  • Responsible for oversight of the Consumer Lending Fair Lending Compliance Program. Conduct fair lending testing or similar analysis to identify adverse compliance trends or harmed consumers using available software programs.
  • Will be the Consumer Lending expert on available software programs. Demonstrate the ability to build and execute routine queries within software and preparing reports and executive summaries.
  • Responsible for compliance program to ensure adequate consumer lending oversight of the Indirect Dealer program, including quality control surveys, complaint management, new dealer onboarding and ongoing risk assessments.
  • Serve as the Bank's subject matter expert to provide compliance advice and guidance for the consumer lending lines of business. Address compliance questions, provide guidance in the development or modification of new products and services, identify any compliance related issues and/or new compliance requirements, and keep abreast of business changes and potential regulatory impact.
  • Proactively research, train and assist the line of business in assessing the impact of a regulation or regulatory change and in the formulation of any mitigation strategies that will balance business need with regulatory compliance.
  • Evaluate line of business action or remediation plans related to second line of defense, internal audit or regulatory findings. Take an active role to ensure adequate resolution of all findings and recommendations.
  • Monitor or participate in teams (e.g. Enterprise Risk Management meeting) or committees that identify and implement new products or services impacting Consumer Lending.
  • Develop effective compliance training and communications to Consumer Lending management and bank employees as necessary. Coordinate or assist in training programs for consumer lending associates. Serve as subject matter expert for consumer lending compliance eLearning courses and work closely with Learning & Development to create custom content as needed.
  • Serve as a resource for regulatory compliance questions and issues for the consumer lending staff. Understand the current or projected trends in consumer lending compliance based on feedback from a network of established industry colleagues, regulatory commentary, educational publications or external training courses.
  • Coordinate with the Marketing Department the review and approval of all marketing and advertising materials, product brochures, new product offerings, for consumer lending that contain regulatory compliance issues or disclosures.
  • Will be responsible for increasing knowledge and awareness of the regulatory climate, new or changing regulations/expectations which includes continued education to maintain necessary skills to perform duties.
  • Assist in special projects or management requests as necessary, including but not limited to, mergers and acquisitions, conversions, participation on internal improvement teams, etc.
  • Prepare and present reports to senior management.

Education, Job Skills and Qualifications:

  • Bachelor's degree.
  • Eight or more years of regulatory compliance background or equivalent banking experience. Thorough knowledge of all applicable federal and state banking laws and regulations.
  • Certified Regulatory Compliance Manager (CRCM), or equivalent, certification preferred or willingness to achieve certification when eligible.
  • Comprehensive understanding of company policies and procedures in place to ensure compliance.
  • Above average knowledge of software and systems used to improve compliance processes and efficiency which includes Microsoft office.
  • Above average written and oral communication skills.
  • Ability to plan and organize resources to achieve goals.
  • Ability to interpret and analyze large data sets and arrive at conclusions or recommendations based on that data
  • Ability to research laws and regulations and make recommendations as to the applicability within a particular control environment.
  • Familiarity with corporate compliance programs, including risk assessments, testing and monitoring, training, policy/procedure development, and implementation of new products and business processes.
  • Excellent communication and composition skills
  • Experience in dealing with examiners, auditors, and front line/entry level associates
  • Ability to research laws and regulations and make recommendations as to the applicability within a particular control environment
  • Able to understand basic process controls and apply the regulations to the process
  • Able to review control issues and determine regulatory risks as they pertain to consumer lending
  • Willingness to continue education by completing qualified continuing education hours annually.

  • Travel required to Peoples Bank offices as well as to various schools, seminars, etc.

Basic Qualifications:

  • Bachelor's degree
